Terms of Service

Effective date: February 21, 2026

These Terms of Service ("Terms") govern access to and use of the TSFM.ai website, playground, APIs, and related services (collectively, the "Service"), operated by TSFM.ai LLC ("TSFM.ai," "we," "our," or "us"). By using the Service, you agree to these Terms.

1. Eligibility and Authority

You must be at least 18 years old and legally able to enter into these Terms. If you use the Service for an organization, you represent that you are authorized to bind that organization.

2. Service Plans and Data Terms by Plan

Different Service plans have different data handling terms. The plan-specific terms below control unless a written enterprise agreement states otherwise.

Guest Playground. Access may be provided without payment. In exchange, you authorize TSFM.ai to collect, store, reproduce, modify, analyze, and use all submitted inputs, outputs, logs, and derived data for any lawful business purpose, including model training, fine-tuning, evaluation, safety, analytics, and commercialization.

Free API. If you use a no-cost API tier, the same broad data-use authorization applies as Guest Playground.

Paid API. Unless you explicitly opt in, content is used to provide, secure, and support the Service and is not used for content-based model training. Service metadata may still be used for operations and service improvement.

Enterprise API. Data use is governed by your enterprise agreement, order form, or DPA. If that agreement conflicts with these Terms, the written enterprise agreement controls for that customer.

3. Acceptable Use

You may not:

  • Use the Service for unlawful, harmful, abusive, or fraudulent purposes.
  • Bypass or interfere with security controls, rate limits, or availability protections.
  • Submit malware or malicious code.
  • Use the Service in violation of applicable law or third-party rights.

For Guest Playground and Free API, do not submit sensitive personal data, regulated health data, payment card data, trade secrets, or other confidential data unless you accept the data-use terms in Section 2.

4. Accounts and Credentials

You are responsible for safeguarding account credentials and API keys and for all activity under your account. We may rotate, revoke, or suspend credentials for security, abuse prevention, or policy enforcement.

5. Fees and Payment

Paid plans and metered features are billed as described on pricing pages, order forms, or enterprise agreements. Fees are non-refundable except where required by law or explicitly stated otherwise.

We may update pricing with reasonable advance notice. Continued use after new pricing takes effect constitutes acceptance of updated pricing.

6. Your Content and License

You retain ownership of content you submit ("Your Content"). You grant TSFM.ai a non-exclusive, worldwide license to host, store, process, transmit, reproduce, and transform Your Content as needed to provide the Service and as permitted by Section 2 (plan-specific data terms).

You represent that you have rights and permissions required to submit and process Your Content through the Service.

7. AI Data Use Policy

Additional AI-specific data handling terms are in our AI Data Use Policy, which is incorporated into these Terms.

8. Privacy and California Notice

Our handling of personal information is described in our Privacy Policy. For California residents, free access programs may constitute a data-value exchange. See our Notice of Financial Incentive.

9. Third-Party Service Providers

We may use third-party service providers for hosting, security, billing, support, and analytics. These providers process data under contractual restrictions.

10. Suspension and Termination

You may stop using the Service at any time. We may suspend or terminate access for Terms violations, abuse, legal compliance, security risks, or non-payment.

On termination, your right to use the Service ends. We may retain data as required for legal, billing, fraud-prevention, and compliance obligations.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, TSFM.AI DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TSFM.AI AND ITS AFFILIATES ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOST PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITY. OUR TOTAL LIABILITY WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR (B) $100 USD.

13. Indemnification

You will defend, indemnify, and hold harmless TSFM.ai and its affiliates from claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the Service, Your Content, or your violation of these Terms or applicable law.

14. Governing Law and Venue

These Terms are governed by Delaware law, excluding conflict-of-law rules. Disputes must be brought in state or federal courts located in Wilmington, Delaware, and you consent to their jurisdiction.

15. Changes to Terms

We may update these Terms from time to time. Material changes are posted with a revised effective date. Continued use after the effective date constitutes acceptance of the revised Terms.

16. Entire Agreement and Contact

These Terms, our Privacy Policy, our AI Data Use Policy, and any applicable enterprise agreement form the full agreement regarding your use of the Service. For legal questions, contact legal@tsfm.ai.
